Chapter 40B Status

Updated as of: 11/9/2023. All of these projects are reviewed as a Comprehensive Permit, or 40B.

BROOKLINE SUBSIDIZED HOUSING INVENTORY

The State periodically certifies the Subsidized Housing Inventory (SHI), which includes deed-restricted affordable units as well as market rate units that are included in comprehensive permit developments. Town staff also updates the state as projects progress forward. The Department of Planning & Community Development (DPCD) estimates Brookline's SHI percentage is 10.07% as of October 13, 2023. 

When the percentage of housing units on the SHI is more than 10% of the town's total housing units, or when the Town has permitted more than 139 SHI-eligible units in the last year and has a current Housing Production Plan, the Zoning Board of Appeals has significantly more discretion in deciding whether to deny a comprehensive permit application. Note that state guidelines stipulate units first come onto the SHI at the time of a decision, and stay on as long as a building permit is issued within 12 months, and if a certificate of occupancy is issued within 18 months of a building permit being issued. 

The 40B project dashboard details how the SHI status dipped below 10% between August 9th and October 13th of 2023, when the 40B application for the Heath & Sheafe Street development was filed. Even if all the 40B projects in the pipeline are delayed further than our current estimate (due to permitting, financing, or construction delays), the earliest we would temporarily fall again below 10% is September 20, 2024, when 108 Centre Street will come off the SHI 18 months after receiving a building permit - and will remain off until construction is complete. This section will be updated again in Spring 2024 once we understand better which 40B developments are moving forward in the 2024 construction season, and which may be further delayed due to market conditions.

HEATH & SHEAFE STREET DEVELOPMENT

  • SHI Status: Units will not appear on SHI if and until ZBA approves the Comprehensive Permit.

FORTY CENTRE STREET

    • Specifications 40 rental residential units, 25 parking spaces, 46 bedrooms plus 16 studios
    • Status Approved with Conditions. ZBA Decision filed 2/8/2017. Abutters filed two appeals.
      • Update 2022: Appellate Court sustained the judgment of the trial court in favor of the developer. The abutters filed an application for Further Appellate Review with the Supreme Judicial Court, but that application was deferred.
      • August 4, 2022 Public Meeting: ZBA determined if proposed project change is  Substantial.
      • November 14, 2022 Public Hearing: ZBA approved modification to reduce parking from 25 to 16
    • SHI Status Building permit issued 9/8/23. 40 units will return to SHI in next state certification. 

108 CENTRE STREET

    • Status: ZBA Approved with conditions Decision filed with Town Clerk 12/29/2021
    • SHI Status: 54 units on SHI. Units will come off the SHI on September 20, 2024 until construction is complete and a certificate of occupancy is received.

BABCOCK PLACE

    • Status ZBA issued Comprehensive Permit; Decision filed April 5, 2018. Obtained Building Permit
      • September 2022 Modification (36 parking spaces increased to 39): Approved
      • June 22, 2023: Hearing for proposed modification (reduce parking from 39 to 23)--APPROVED WITH CONDITIONS. Decision filed 7/31/2023.
    • SHI Status 45 units eligible for SHI. Construction largely complete; temporary Certificate of Occupancy has been issued. Units will be added to the SHI once a final Certificate of Occupancy is issued following spring 2024 landscaping.

ELEVEN80 

    • INITIAL project approved in 2017 ELEVEN80-2017 45 age-restricted (55+) rental units plus retail, 69 parking spaces, 74 bedrooms

HAMPTON COURT

RESIDENCES OF SOUTH BROOKLINE

ZBA approved a request for an Insubstantial Change to the Comprehensive Permit on 4/18/2019 to reduce the height and reorient the 11 buildings in the buffer zone and increase the number of units in the Asheville building by 18 units and the SHI units from 161 to 175.
    • SHI Status 175 units eligible for SHI. Construction completed; Certificate of Occupancy has been issued. 5 units are currently included on the SHI and another 170 will be on the next SHI certification.
